Eat AI Terms of Service

Welcome to Eat AI. By downloading or using the App, you agree to these terms. If you do not agree, do not use the App.

1. The Service

Eat AI provides AI-assisted calorie and macronutrient estimation based on photographs of food. Estimates are generated by a machine learning model and should be treated as approximations, not medical or dietary advice.

2. Not Medical Advice

Eat AI is a general consumer tool and is not a substitute for professional medical, nutritional, or fitness advice. Consult a qualified professional before making dietary decisions based on the App, especially if you have a medical condition.

3. Your Account

You are responsible for all activity on your account. Do not share access with others. If you suspect unauthorized use, contact support@trialanderror.ai.

4. Subscription and Billing

• Eat AI offers a limited free tier and optional paid subscriptions processed through the Apple App Store.
• Current plans: Monthly at $19.99/month and Annual at $149.99/year.
• Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before renewal.
• You can manage or cancel subscriptions in your iOS device under Settings > Apple ID > Subscriptions.
• Refunds are handled by Apple under their standard App Store policy.

5. Acceptable Use

You agree not to: (a) upload content that is illegal, infringing, or abusive; (b) attempt to reverse-engineer the App or its underlying models; (c) use the App to harm others or misrepresent outputs as medical advice; (d) disrupt or probe the service infrastructure.

6. Intellectual Property

The App, including its design, code, and model outputs, is owned by Trial and Error Inc. You retain ownership of the photos you submit. By submitting a photo, you grant us a limited license to process the image for the purpose of providing the service.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DO NOT GUARANTEE THE ACCURACY OF AI-GENERATED ESTIMATES. YOUR USE OF THE APP IS AT YOUR OWN RISK.

8. Limitation of Liability

To the maximum extent permitted by law, Trial and Error Inc. and its affiliates are not liable for indirect, incidental, or consequential damages arising from your use of the App. Our total liability for any claim is limited to the amount you paid for the subscription in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your access if you violate these terms. You may stop using the App and cancel subscriptions at any time.

10. Governing Law

These terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of law principles. Disputes will be resolved in the state or federal courts located in Massachusetts.

11. Changes

We may update these terms. Material changes will be announced in the App and on this page. Continued use of the App after an update constitutes acceptance of the revised terms.
